A Review Of A number of Personal Injury Cases Where A Motor Vehicle Incorrectly Entered A Crosswalk And Seriously Injured A Pedestrian

So you make sure that you cross a street at a marked crosswalk. If only there were a guarantee that drivers would stick to the rules and grant pedestrians in a crosswalk the right of way. Case 2: A driver was speeding in a heavily trafficked area of a large metropolitan city. There were a large number of pedestrians in the area. The driver was operating a rental car. He went through a red light and slammed into a van. The force of the impact forced the van onto the crosswalk while a twenty five year old man was crossing the street at the crosswalk. As a result of the accident, the man suffered a thoracic level spinal cord dislocation causing complete paralyzes from the chest down.. The law firm that handled this claim filed a claim for the pedestrian victim against the driver and the car rental company. Unable to reach a settlement, the law firm took the case to trial. The jury verdict was partially upheld in the amount of $20,300,000 by the trial judge. This sum was designed to cover medical expenses (for the amount incurred up to the trial and for the amount for the care he will need in the future), the pedestrian’s loss of earning capacity, and past and future pain and suffering.

Case 3: In this case the report mentioned that as a school bus made a left hand turn the driver failed to yield the right of way to a pedestrian. The bus ran over and pinned the pedestrian’s foot. At the time of the accident the victim, a female, aged fifty four, was in a designated crosswalk walking over to the other side of the intersection. The driver of the bus was ignorant of what had happened. It took the efforts of witnesses getting the driver’s attention and getting the driver to go into reverse so that the wheel of the bus would release the pedestrian’s foot. The pedestrian suffered various major injuries to her foot and leg. The pedestrian wound up requiring several surgeries to both her foot and her leg. Ultimately, though, she lost the leg to a below the knee amputation after which she experienced chronic phantom pain. The report of this matter by the law firm that handled it indicated that they took the case to trial and attained a jury award for $5.9 Million for the pedestrian.

By comparing and contrasting these claim we discover first that each case is distinct. Extrapolating from the claim it is clear that a case can involve a car, a bus, a truck, or even a motorcycle. The plaintiffs, even when we consider cases involving only pedestrians, can be male or female and can be any age.

The cases, however, all seem to share two basic things. The injuries are often major and leave the victims with permanent problems. Crosswalks are no guarantee of safety for a pedestrian. Drivers can be distracted even in clearly marked crosswalks. And some drivers simply neglect to follow the rules such as the speeding driver who went through a red light in the second claim.
